Mission and vision
CAPC goals include contributing to reducing corruption in the country to a level that does not affect the citizens’ rights and freedoms; enhancing awareness of the danger to the state posed by corruption; studying the level of corruption penetration in the society and the state; determining the areas which were most affected by corruption; enhancing the level of transparency in the activity of state and political institutions; establishing a monitoring on the activity of state bodies in society.
General description of the CSO work in the anti-corruption area
To achieve its goals, CAPC carries out the following activities: working with the media, public associations, public authorities, as well as central and local public authorities; cooperating with international organizations and associations that have similar goals through information sharing; carrying out opinion polls; monitoring the activity of various institutions, including those relating to transparency, formulating at the same time recommendations to reduce the risk of corruption; monitoring the progress of criminal trials pertaining to corruption as they can easily be covered up; contributing to draft legislation on preventing and combating corruption and protecting human rights in accordance with international instruments to which Moldova is a party; contributing to the development of codes of ethics for public officials and judges; contributing to the media coverage of the danger of corruption; establishing and operating a hotline for granting people the possibility to inform us anonymously about corrupt acts; summarizing obtained information and identifying areas and institutions susceptible to corruption; as well as organizing trainings, conferences, and roundtables in the field of anti-corruption.
Specific description of the CSO work in relation to the UNCAC
The main strategic priorities of CAPC (in relation to the UNCAC) are:
- Contributing to improve the process of law-making (i.e. corruption proofing of draft legislative acts). To achieve this goal, CAPC participates in the following activities: reviewing the legislation in terms of corruption clauses; reviewing the legislation in terms of compliance of the acquis communautaire; implementing an effective tool for normative creation at the local level; effectively contributing in drafting legislation; disseminating the information on legislation being drafted; as well as maintaining and creating new platforms for debate on the quality of legislation.
- Contributing to the effective implementation of laws. In order to achieve this priority, CAPC participates in the following activities: providing legal assistance to citizens; maintaining the database “www.interese.md”; organizing specialized training for journalists and civil society representatives; as well as monitoring the implementation of anti-corruption laws.
- Contributing to the media coverage of the corruption phenomenon and civic education. In order to achieve this priority, CAPC participates in the following activities: conducting studies and surveys aimed at preventing and combating corruption; conducting studies and surveys outlining the impact of corruption on human rights; developing tools/complex methodologies for measuring corruption; participating and organizing TV and radio broadcasts; as well as organizing and participating in various social campaigns.
- Contributing to improving the activity of public bodies. In order to achieve this goal, CAPC has outlined the following activities: monitoring of public authorities; monitoring and evaluation of public policies; monitoring political processes; monitoring economic processes.
Specific description of the CSO work in relation to the review mechanism of the UNCAC
CAPC, jointly with Transparency International Moldova, monitored in 2013 and 2014 the implementation by 20 public authorities of the following anti-corruption policies: the application of the internal preventive mechanism of corruption; reporting of income and assets; the promotion of ethical standards, the management of conflicts of interest; the promotion of transparency and accountability in the management of public finances; the quality of hotlines; petition effectiveness; the quality of websites of public authorities.
CAPC participated in the interview with the UNCAC evaluators, providing information on the implementation of the legal framework on the criminalization, detection and repression of acts of corruption. There were no barriers to the participation of representatives of CAPC in the first review cycle.
Since 2006, CAPC has launched the project “Corruption proofing”. In 10 years, CAPC examined over 725 draft laws, mostly of them being taken over from the Parliament website and some expert reports were prepared and offered by CAPC at the express request of some public authorities (regularly Ministry of Justice and National Anticorruption Centre). Project mission consists of: „Prevention the spread of corruption in the Republic of Moldova by removing flawed norms from draft laws”.
Project Objectives are:
- Remove risks of corruption in draft laws provisions by revealing legal provisions generating or favouring acts of corruption and by making recommendations for improvements;
- Increase public oversight of the legislative activism of the parliamentary members;
- Ensure dissemination of balanced information about corruption and discrimination risks of the upcoming legislation.
In their reports, our experts raised objections concerning more than 9000 elements of corruptibility detected in the examined draft laws. The use of this new type of expertise, tested for 10 years, increased the transparency of the whole legislative process and was fairly efficient, with 52% of the objections thus accepted by Parliament.
